1. General Provisions

1.1. This online store is operated by Szymon Płotkowski, conducting business at Luszkówko 5, 86-120 Pruszcz, Poland. NIP (Tax ID): 5591989458, VAT EU: PL5591989458. Contact email: contact@3dcoq.com.

1.2. The store operates at the domains 3dcoq.com and 3dcoq.pl and offers 3D-printed products, digital files (STL, OBJ), and related accessories.

1.3. These Terms & Conditions (hereinafter “Terms”) define the rules for using the store, placing orders, delivery, payments, returns, complaints, and liability.

1.4. By placing an order, the Customer confirms they have read and accepted these Terms.

1.5. The governing law is the law of the Republic of Poland, including in particular the Act of 30 May 2014 on Consumer Rights (Dz.U. 2014 poz. 827, as amended) and the Civil Code (Kodeks Cywilny).

2. Definitions

  • Seller — Szymon Płotkowski, as described in section 1.1.
  • Customer — any natural person, legal entity, or organizational unit placing an order in the store.
  • Consumer — a Customer who is a natural person making a purchase not directly related to their business or professional activity (Art. 22¹ of the Civil Code).
  • Store — the online store at 3dcoq.com / 3dcoq.pl.
  • Product — an item or digital content offered for sale in the Store.
  • Order — a Customer’s declaration of intent to purchase a Product, submitted via the Store.
  • Made-to-order product — a 3D-printed item manufactured specifically for the Customer after the order is placed.

3. Orders & Prices

3.1. Orders can be placed 24/7 via the Store website.

3.2. To place an order, the Customer selects a Product, adds it to the cart, provides delivery details, chooses a payment method, and confirms the order.

3.3. All prices displayed in the Store are gross prices (including VAT where applicable) and are stated in the currency shown on the product page.

3.4. The total order cost includes the product price and shipping cost, both displayed before the Customer confirms the order.

3.5. An order is confirmed when the Customer receives an order confirmation email from the Store. The sales contract is concluded at that point.

3.6. Accepted payment methods: Stripe (credit/debit cards) and PayPal.

3.7. The Seller reserves the right to cancel an order if the payment is not received within 3 business days of placing the order.

4. Delivery

4.1. The Seller ships worldwide. Specific delivery options and costs are calculated at checkout based on the weight and destination of the order.

4.2. Some products are manufactured on demand. Please allow 1–5 business days for production before dispatch.

4.3. Estimated delivery time after dispatch: 3–7 business days, depending on the destination country and courier service.

4.4. The risk of loss or damage passes to the Customer upon delivery. If the parcel is visibly damaged on arrival, the Customer should note this with the courier and contact the Seller immediately.

4.5. Digital products (STL, OBJ files, digital gift cards) are delivered electronically via download link after payment is confirmed.

5. Right of Withdrawal

5.1. In accordance with Directive 2011/83/EU and the Polish Act of 30 May 2014 on Consumer Rights (Art. 27), a Consumer has the right to withdraw from the contract within 14 days from the day of receiving the goods, without giving any reason.

5.2. To exercise the right of withdrawal, the Consumer must inform the Seller of the decision by an unequivocal statement (e.g., by email to contact@3dcoq.com). The Consumer may use the following template:

“I hereby inform that I withdraw from my contract of sale of the following goods: {product name}, ordered on {date}, received on {date}. Consumer name and address. Date.”

5.3. The withdrawal period expires 14 days after the day on which the Consumer or a third party indicated by the Consumer (other than the carrier) acquires physical possession of the goods.

5.4. Exceptions to the right of withdrawal (Art. 38 of the Consumer Rights Act):

  • Products manufactured to the Consumer’s specifications or clearly personalized (custom 3D prints with non-standard dimensions, colors, or designs).
  • Digital content delivered on a non-tangible medium (e.g., STL/OBJ files), if the performance has begun with the Consumer’s prior express consent and acknowledgment that the right of withdrawal is lost.

5.5. The Consumer bears the direct cost of returning the goods unless the Seller has agreed to bear them or has failed to inform the Consumer about the obligation to bear those costs.

6. Returns & Refunds

6.1. The Consumer must return the goods without undue delay and in any event no later than 14 days from the day of communicating the withdrawal. The goods must be unused and in the original condition and packaging.

6.3. The Seller will reimburse all payments received from the Consumer, including the cost of standard delivery (the cheapest delivery option offered), within 14 days of receiving the returned goods or proof of return shipment, whichever is earlier.

6.4. The refund will be issued using the same payment method used for the original transaction, unless the Consumer has expressly agreed otherwise.

6.5. If only part of the order is returned, the Seller refunds the product cost of the returned items. The original delivery cost is not refunded in the case of a partial return.

7. Complaints & Statutory Warranty (Rękojmia)

7.1. The Seller is liable to the Consumer for any lack of conformity of the goods with the contract (statutory warranty / rękojmia) in accordance with Articles 556–576 of the Polish Civil Code.

7.2. If a Product is defective, the Consumer may:

  • Request repair or replacement of the Product.
  • Submit a statement of price reduction.
  • Withdraw from the contract (if the defect is significant).

7.3. To file a complaint, the Consumer should email contact@3dcoq.com with:

  • Order number
  • Description of the defect
  • Photos of the defective product
  • Preferred resolution (repair, replacement, refund)

7.4. The Seller will respond to the complaint within 14 days of receipt. Failure to respond within this period means the complaint is deemed accepted.

7.5. The Seller’s liability under the statutory warranty covers defects discovered within 2 years from the date of delivery to the Consumer.

8. Intellectual Property

8.1. All content available in the Store — including product designs, 3D models, photographs, descriptions, logos, and graphics — is the intellectual property of the Seller or used with permission, and is protected by applicable copyright and intellectual property laws.

8.2. Purchasing a product does not transfer intellectual property rights. The Customer may not reproduce, distribute, or commercially use the designs or 3D models without the Seller’s written consent.

8.3. Digital products (STL, OBJ files) are licensed for personal, non-commercial use only, unless otherwise stated in the product description.

9. Limitation of Liability

9.1. The Seller’s liability is limited to the extent permitted by applicable law. In particular, the Seller shall not be liable for:

  • Damage resulting from misuse of the Product by the Customer.
  • Minor differences in color or finish due to the nature of 3D printing technology and screen display settings.
  • Delays caused by courier services or customs clearance.
  • Force majeure events.

9.2. This clause does not limit any mandatory consumer rights under applicable law.

10. Personal Data

10.1. The Seller processes personal data in accordance with the General Data Protection Regulation (GDPR) and Polish data protection laws. Full details are available in our Privacy Policy.

10.2. Information about cookies and tracking technologies is available in our Cookie Policy.

11. Final Provisions

11.1. These Terms are governed by the laws of the Republic of Poland.

11.2. Any disputes arising from contracts concluded through the Store shall be resolved by the competent court having jurisdiction over the Seller’s registered address. This provision does not apply to Consumers, who may bring proceedings before the court having jurisdiction over their place of residence.

11.3. The Consumer may use out-of-court complaint and redress mechanisms. In particular, the Consumer may:

  • Apply to the competent Provincial Inspector of the Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej) for mediation.
  • Apply to a permanent amicable consumer court (stały polubowny sąd konsumencki) for dispute resolution.
  • Use the EU Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.

11.4. The Seller reserves the right to amend these Terms. Changes take effect 14 days after publication on the Store website. Orders placed before the effective date of changes are governed by the Terms in force at the time the order was placed.

11.5. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
